Terms & Conditions
We would like our customers to know that we are a friendly and honest company and it is in everyone’s best interest to know how we wish to trade with them and let them know at the onset how they stand with us. Please take your time to read through the relevant sections of these Terms and Conditions before signing this.
- EXPRESS MARBLE & GRANITE Ltd of Braintree House, Unit 2 Braintree Road, Ruislip, Middlesex, HA4 0EJ reserves the right to : Update these terms from time to time and any changes will be notified to you via our website. If you do not agree or accept the new conditions you should not continue to order any further products. If you continue to order after the date on which changes come into effect your orders or purchases indicate your agreement to be bound by the new terms.
- The following Terms and Conditions apply to all products sold, Worktops that are supplied and fitted exclusively and Kitchens that are “Supplied & Fitted or Exclusively Supplied” by EXPRESS MARBLE & GRANITE Ltd.
- INTERPRETATION
- “You; Your/s; they; The Customer, The Buyer, The Client”, and “the Order, Furniture; Goods” shall be as specified in the “The Contract” “template form” “sign off sheet or after sale note” or “Client Project Information For Supply Only Supply Fit
- “We; Us; Our” EXPRESS MARBLE & GRANITE Ltd
- “The Contract” the contract for the sale or supply of Goods and or Services including any amendments there to be agreed in writing by the client and EXPRESS MARBLE & GRANITE Ltd.
- “Third Party Trade Person/s” those of the Services which comprise of Stone mason, template, installation, carpenter, plumber, electrician, plaster, tiler, builder of any other type of skilled manual worker.
- “The Conditions” the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) including any special terms agreed in writing between EXPRESS MARBLE & GRANITE Ltd. and the client.
- PERSONAL INFORMATION
- You warrant that the personal information which you provide to complete debit, credit card or another payment transactions are true, accurate, current and complete in all respects.
- You are not impersonating any other persons or entity.
- PRIVACY POLICY
- EXPRESS MARBLE & GRANITE Ltd. will treat all your personal information:
- As confidential and will only disclose the same in the circumstances set out below: and in accordance with Data Protection legislation in force in England and Wales.
- When you shop with EXPRESS MARBLE & GRANITE Ltd., we may ask you for personal details in order for us to identify you such as your name, address, billing and delivery address, credit card and payment information. We confirm that this information will be held by us in accordance with the (DATA protection Act 1998). You should be aware that if the police request us or any other regulatory authority investigating suspected illegal activities to provide your personal information, we are entitled to do so.
- INDEMNITY
- You agree to fully indemnify, defend and hold us, and our offices, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms by you, or any other liabilities arising from use of our service or any other person accessing our service using your personal information.
- THIRD PARTY LINKS
- As a convenience to our customers, we may recommend and the website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse these.
- We will not be liable, whether directly or indirectly for the privacy practices or content of such, websites or companies nor for any damage , loss or offence caused or alleged to be caused in connection with, the use or reliance on any such advertising, content, products, material or services available on such external websites or alleged be caused in connection with , the use of or reliance on any such advertising content, products, material or services available on such external websites or sources.
- ORDERS, DELIVERY & FULFILMENT
- All orders are subject to acceptance and availability. If the goods ordered are not available for any reason, you will be notified by telephone (or by other means if no telephone number/s are provided). You will have the option either to wait until the item is available from stock or to cancel your order. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. The conclusion of a contact between you and us will take place when we dispatched the goods to you or commence the services; whoever is earlier. By accepting these terms and conditions when you make a purchase, you authorize us and card processing company to process payments from the credit or debit card details supplied and to conduct validation checks by cross checking your details. We will take all responsible care, in so far it is in our power to do so, to keep the details of your order and payment secure, but in the absence or negligence on our part, we cannot be liable for any loss you will suffer if a third party procures unauthorized access to any data provided by you when accessing or ordering from us. From time to time EXPRESS MARBLE & GRANITE Ltd reserves the right to perform additional security checks.
- Once you have ordered a product from us, we aim to deliver normally within 48 hours from the date of acceptance. If due to unforeseen circumstances, we cannot deliver on time we will try to contact you to make an alternative arrangement that suit both parties. We will endeavour to complete all orders for goods and services within 28 working days. Method of delivery will vary dependant on the cost and weight of goods purchased.
- Parcels and small packages will be sent either by Royal Mail or Private Courier, crates and heavier items will be sent via Signet Transport or our own transport.
- Goods can be delivered between 8:00 and 17:30 unless a timed delivery has been paid for. If you are not at home on the agreed date the items will be taken back to your nearest depot and re-delivery will be arranged between yourself and the courier. If this happens with larger pallets and crates a 2nd delivery charge may be incurred which you will be notified and charged for.
- If for whatever reasons we are unable to fulfil the agreement to supply you with your goods within 28 working days, we will offer a refund with the same method the original payment was taken. Subject to any rights granted to you under applicable consumer law, we accept no liability for any failure to ship products where the results from our liability to do so or our decision on reasonable grounds not to do so, if we have taken reasonable steps to notify you within 14 days of placing the order that the goods will not be shipped as ordered. It ids your responsibility to ensure that you order from us with sufficient lead-time to prevent any loss or disappointment resulting from such non-shipment.
- The Company reserves the right to make deliveries/ and or services by instalments and to render a separate invoice in respect of each such instalment.
- If the Company exercises its right to make deliveries/and or services in accordance with sub-paragraph 7.6, then any delay in the provision of such deliveries/and instalment, shall not entitle the Buyer to reject the Contract or the delivery/service of any other instalment or to withhold payment in respect of any instalment previously delivered/serviced.
- Some items due to their weight/ size may require an able-bodied person present at delivery.
- RETURNS AND REFUNDS
- Where you are a consumer purchasing products from us, you are eligible to our 7 day return policy. In this instance you must call our customer service team on 020 8841 2980 to arrange and organize safe return of goods.
- You will be eligible for a refund minus the cost of delivery back to us. You must retain possession of the goods or services and ensure that the goods or services are kept in the same condition, as they where when they were delivered until such time as the goods or services are delivered back. We will refund any monies owed within 30 days of receiving the goods or services, providing the goods or services are returned back complete, in the same condition, and are not affected by customer induced damage.
- Failure to follow the process detailed above may result in refunds or exchanges being refused.
- DAMAGED GOODS
- If in the unlikely event you receive goods which are damaged you must inform us immediately on 020 8841 2980 or Email [email protected]
- You must inform the office within 3 days of receiving the goods and you may be asked to provide photos or detailed description of any damages.
- If damage is reported after 3 days it is at the director’s discretion and any damage reported after 7 days will not be eligible for refund, exchange or compensation.
- Orders are accepted and dates for delivery given, conditionally upon our being to secure the necessary labour and materials, and without responsibility for delays arising through risks and uncertainties of manufacture, accident and strikes, and other causes beyond our control.
- PRICES AND PAYMENT
- All prices are exclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information on our system. We reserve the right, however, to change prices at any time without notice to you.
- We accept Visa, Delta, MasterCard, Switch, Solo, Electron, JCB and Paypal.
- Payment will be taken from your card immediately as you place the order. Any refunds to cards may take up to 5 working days for your bank to process and we cannot be held responsible for any delays in refund payments.
- You confirm that the credit or debit card that is being used is yours. All credit and debit cardholders are subject to validation checks and authorization by the card issuer.
- If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us we will not be liable to you for any delay or non-delivery.
- No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
- The Price for the Goods and or Services shall be paid in accordance with the provisions set out in Express Marble & Granite Ltd quotation.
- If payment for the price of the contract or any part of it is not made by the due date then without prejudice to all or remedies against the client Express Marble & Granite shall be entitled to charge interest on any balance outstanding at a rate of 2.5% above the base lending rate of HSBC Bank PLC.
- If any monies are not paid by the due date to Express Marble & Granite Ltd under this contract or otherwise, Express Marble& Granite Ltd shall be entitled to demand immediate payment of all sums due and to cease all contract works in progress for the client, without incurring any liability whatsoever, until such payment is made.
- All kitchens, bathrooms, worktops, tiles, appliances, sinks & taps and accessories remain property of Express Marble & Granite Ltd until paid for in full.
- Please note all payments made using credit cards will incur a surcharge of 2.5% and 3.2 % for business cards.
- Express Marble & Granite Ltd will request 50% of the invoice value on order confirmation on the supply and fit or supply only of your kitchens, bathrooms & worktops.
- Express Marble & Granite Ltd will request 100% of the invoice value on order confirmation purchase of appliances, tiles, sinks & taps and accessories.
- All payments and final balances need to be made to Express Marble & Granite Ltd in clear funds 4 working days before the delivery of your kitchen or bathroom. Failure to provide this payment will result in a delay in delivering your kitchen or bathroom.
- SUPPLY & INSTALL & SUPPLY ONLY
- Express Marble & Granite Ltd has no control over the manufacturer’s timeline for production, loading of containers or delivery.
- The order confirmation signed by the client will be the final kitchen that the client will receive at time of delivery. Any amendments made after the order confirmation has been signed will be made at the cost of the client.
- If Express Marble & Granite Ltd makes any amendments to the order confirmation and this has an impact to the fitting of the kitchen it is not the customer’s responsibility to meet the cost and provide additional pieces of furniture.
- If the client makes any amendments to the order confirmation and this has an impact to the fitting of the kitchen it is not Express Marble & Granite Ltd’s responsibility to meet the cost and provide additional pieces of furniture. Express Marble & Granite Ltd will provide any additional pieces of furniture required.
- It is the clients’ responsibility if they are using their own fitter to exhaustively check that they are completely satisfied with all the dimensions that you the client have provided. This includes kitchen size, height of the room, units, colour, style and position all doors, windows, switches, socket, gas supply, water supply and drainage.
- Unless the order confirmation and the Terms & Conditions are signed, Express Marble & Granite Ltd will not proceed with the manufacturing of your kitchen.
- We will offer you the client, the first available date and time for delivery of your kitchen. It is the client’s responsibility to ensure that there is adequate space to store the kitchen. The storage area will need to be clean, dry, secure and clear.
- It is the responsibility of Express Marble & Granite Ltd to deliver your kitchen as per the order confirmation. This covers the kitchen style, colour and any additional requirements for your kitchen. If we do not fulfil our duty with any of the mentioned we will incur any cost to replace and deliver these items.
- If the client has requested the kitchen be supplied only, it is the responsibility of the client to arrange the kitchen collection and delivery to the site address, Express Marble & Granite Ltd will endeavour to assist you to move the kitchen in to the allocated space. Health and safety grounds require more than a two-man delivery. If you request this additional service we will advise you of any extra cost involved in delivering before your order is processed.
- In circumstances where Express Marble & Granite Ltd have agreed to have the kitchen delivered to the site address it is your responsibility to have someone available to assist you to move your furniture to a suitable location.
- In cases where Express Marble & Granite Ltd has been instructed to Supply & Fit your kitchen Express Marble & Granite Ltd is responsible for removing and transferring your kitchen from the vehicle to the suitable location.
- It is your responsibility to allocate space inside.
- If you cannot be present at the time of the delivery, you must arrange to have a responsible person available at the tihme of the delivery who is authorized to inspect, accept and sign for the kitchen before our driver departs. We strongly advise you to thoroughly check all your order upon receipt to protect your interests. Express Marble & Granite Ltd will accept no responsibility for any claims concerning short delivery and/or damaged and/or defective goods found on delivery, or concerning damaged or defective goods found once you have checked and signed and our driver has departed.
- Once goods are checked and signed for it is your responsibility to meet the cost of any replacement pieces of furniture.
- If delivery to the designated room involved limited maneuverability because of narrow halls, doorways or stairways, etc, we are not responsible for any damage that could result in attempting placement.
- Upon providing and inside delivery service we only deliver through a ground floor or basement entrance and go up to a second floor level. We cannot deliver above this level unless there is suitable lift access. If you have any special delivery request there will be an extra charge to the client.
- You are solely responsible for clearing the designated room and path leading to it of any obstacles in advance of the delivery. Unless notified prior to delivery, our delivery driver will not be responsible for moving or dismantling the furniture.
- Express Marble & Granite Ltd require a clearing clearance of 900mm to ensure all pieces of furniture are able to enter both property and kitchen area.
- Where applicable there may be a delivery charge which will be agreed before delivery.
- If a scheduled delivery is cancelled, refused, or no one is at home to accept it, you the client will be charged a fee to re-delivery, this fee must be paid prior to the second redelivery. This repeat delivery charge will also apply if you cancel an agreed delivery date/time slot less than 2 working days prior to the agreed date.
- Express Marble & Granite Ltd will be happy to accommodate and store your furniture until you are ready to receive it (for up to 2 weeks from the date that the delivery has been received by Express Marble & Granite Ltd). If you fail to accept delivery and it is necessary for us to store your furniture we will charge you a storage fee as per the company used.
- Upon completion of any installation by Express Marble & Granite Ltd; it is the client’s responsibility to take care, safety and cleanliness of the kitchen.
- If we are fitting your kitchen it is your responsibility to contact the supplier of your work top and make the relevant arrangements for templating and fitting.
- If we are not fitting your kitchen it is your responsibility to ensure that there is sufficient access for installation of your work tops and liaise with the supplier of your worktop.
- EXPRESS MARBLE & GRANITE Ltd TRADESPERSON
- If you request Express Marble & Granite Ltd trades persons to carry out the work of fitting your kitchen and cancel the agreed date you would be charged a daily rate of £200.
- SPECIFICATION
- As per specification of quotation of the fit from the client we will complete the tasks as per the quotation. It is our obligation to complete all tasks as per specification.
- Price given for fit is assuming these are as per the final signed drawings. We also expect all flooring to be level and ready for base units and tall units to be fitted. We also expect all walls to be flush and level ready for tall & wall units to be fitted. The client will incur charges to modify the furniture, i.e, If the floors are uneven and the walls are not flush, our furniture will need to be modified. These modifications are neve included in the original quotation.
- When Express Marble & Granite Ltd arrive to carry out installation of your kitchen if any amendments have been made to the kitchen size, height of the room, position of the doors, windows, switches, sockets, gas supply, water supply or drainage and this requires additional furniture this cost will not be covered by Express Marble & Granite Ltd.
- COMPLETION
- Upon completion of any installation by Express Marble & Granite Ltd it is the client’s responsibility to take care, safety and cleanliness of the kitchen, bathroom, worktop, and appliance.
- APPLIANCES
- If You are supplying to your own appliances and they are not the standard industry size 600mm deep, you must inform Express Marble & Granite Ltd of this before you sign your order confirmation. This is to ensure that the correct pieces of furniture & worktops (if supplied) are ordered.
- If you fail to inform us of the correct appliance size and additional pieces of furniture that you require when ordering any additional pieces of furniture after your order confirmation is signed these will be charged at your expense.
- If Express Marble & Granite Ltd is not supplying your appliances; Express Marble & Granite Ltd is not responsible for any additional parts required for your appliances. WE are able to advise you on where and how to purchase any additional parts or plumbing if you request this service from us.
- If any appliances delivered from our suppliers are found to be damaged or faulty then please contact Express Marble & Granite Ltd within 3 working days. If your product does have a fault and it is within the manufacturer’s warranty period then we will assist in any way that we can to provide you with the necessary spare parts, a replacement or if a replacement is not available a refund. We are happy to refund/ exchange items that are damaged in transit, faulty, not what you ordered or if you simply changed your mind, so long as the item is unused and returned in its original packaging with all accessories supplied.
- If you are sourcing your own appliances it is your responsibility to inform Express Marble & Granite ltd. We are happy to provide and advise but the final responsibility lays with the client.
- If you include and AGA or Range cooker in your kitchen these appliances are positioned and fixed it is not our duty to make amendments to the furniture. We are prepared to make amendment/s at the cost of the client
- WORKTOPS
- Quoted prices are a true reflection of the original dimensions given by you at the time of order. If dimensions differ and new previously unmentioned areas need to be completed the price will reflect these changes and is subject to change. All changes will be confirmed and agreed prior to any fabrication.
- An order confirmation will be given at template or prior and must be signed before any work can be carried out. The price quoted on this form will be for the work mentioned ad this work only.
- A deposit of the required amount will also need to be paid at this time.
- Prior to template, we ask all customers to have their units in place, all worktops removed and any new sinks/hobs in hand as we may need to take these away during cutting. If we are unable to complete the template due to non attendance on the agreed day and time you may incur a 2nd template call out charge.
- We strongly advise all customers to confirm with their kitchen manufacturer that their units will support the weight of granite or quartz worktops. (Solid granite weighs 90 kgs per square metre). We cannot accept responsibility for damage to units that has been caused by the weight of worktops we have fitted.
- The maximum length of worktop may be significantly reduced if you require a large cut out, especially granites with larger crystals as they are ‘softer’.
- If you’re having granite, marble, quartz or glass splashbacks we would strongly recommend that any sockets on this part of the wall should be relocated. Not only is this aesthetically far more pleasing, it is likely to be less expensive than cutting the holes through the granite, for which there would be an extra charge.
- Natural Variance Granite, Marble, Limestone, Sandstone and Travertine are all 100% natural stone and as such are prone to natural variations within the pattern, colour and texture. All natural stone sent by us will be from the same crate or batch meaning they will be as perfect match as physically as possible.
- You will receive an official quotation, which outlines Express Marble & Granite Ltd’s proposal for your worktop project. All details provided by you will be included in the quotation.
- We will offer you “ the Client”, the first available date and time which is suitable for you: either (morning 8am- 12 pm) or afternoon (12pm to 4pm).
- We may arrive later or have to reschedule than the agree time due to matters outside of our control such as adverse weather conditions, traffic, breakdown & accidents.
- The client will be charged £150 if the site and cabinets are not fully installed prior to a template and if the template has to be rebooked. The same will apply if the site is not ready for installation.
- The installation team who enter your property will be officially employed by Express Marble & Granite Ltd and will not and will not be subcontracted.
- If you cannot be present at the time of templating/installation you must arrange to have responsible person present at time of templating/installation.
- If requested Express Marble & Granite Ltd can phone the client 1 hour before our template team arrives.
- Once a template appointment is requested the template usually take place within 10 working days.
- At the time of templating, Express Marble & Granite Ltd will give you a Welcome Pack, this is a detailed guide explaining what we do, when we do it and the methods we use.
- Express Marble & Granite Ltd requires the client to make sure that all base (and in some circumstances) wall cabinets are fully secured and fitted beforehand and that all sinks, taps and hobs are present. If you are only replacing your worktops we ask that all current sinks and hobs are disconnected and your current worktops are removed.
- After the template has been successfully completed you are given the opportunity to contact the office on 020 8841 2980 and speak to member of the team to discuss any changes to your quote that you may have made or wish to make.
- We require 50% of the total value at template as your deposit either before templating or given to the template on the day or paid over the phone while the template is at your property.
- The deposit is non refundable once the stone has been cut or ordered from suppliers as it cannot be sent back.
- After the template is completed, we will contact you to give you an installation date.
- The installation date is usually 7-10 working days from the date of the template. Except in unusual circumstances. Subject to the initial deposit being paid on the day of template.
- Once installation has been completed, the installation team will contact the Express Marble & Granite Ltd and we answer any final questions/requirements and ensure you are happy with the installation.
- Your final 50% payment is due on the day of installation. You can either make a payment before the installation or the payment to the installation team on the day or paid over the phone once the installation is completed.
- Express Marble & Granite Ltd guaranteed all workmanship for a period of 6 calendar months, from the date of completion of install. After such a date a charge will be incurred for the cost of the travel, and repair of the worktop in question, which will be payable by the client.
- Any damage, scratches or marks noticed after any installation team has left site will incur charges for the return to site. This will be charge to the customer at the standard outcall rate of £150 per visit.
- Any marks, scratches or chips which are concluded to be part of the natural makeup of the material will mean Express Marble & Granite Ltd are not required to replace or repair the worktop or material in question.
- Express Marble & Granite Ltd requires all clients or customers both public and trade to take sole responsibility for making sure there work.
- INSTALLATION
